Terms and Conditions

These Terms govern your access to and use of Colour Curver, including the public website, the editor, account and billing surfaces, published palettes, private sharing tools, collaboration features, beta programmes, and the current plugin integrations. They are written for Colour Curver's current Australia-first, founder-operated stage before a company is formally registered. Last updated: 23 April 2026.

Who We Are

Colour Curver is currently operated by Ruben Rekker as an individual based in Australia while the service is being validated before a company is formally registered. In these Terms, references to Colour Curver, we, us, and our mean that current individual operator unless and until these Terms are updated following a later company formation, transfer, or restructuring. Eligibility And Accounts

You must be at least 13 years old to use the service. If you create an account, request beta access, accept an invite, or purchase a subscription on behalf of a business or legal entity, you represent that you can form a binding agreement and that the information you provide is accurate and current.

You are responsible for maintaining the confidentiality of your sign-in credentials, invite links, private-share tokens, and any passwords you apply to private sharing surfaces. You are also responsible for activity that occurs through your account or under credentials you control.

Some accounts and invites require email confirmation, password recovery, or additional access review before full access is granted. We may rely on those flows to confirm identity, route access, and protect the service.

Service Scope And Beta Features

Colour Curver currently provides palette-creation tooling, public and private palette publishing, export formats, team and workspace collaboration, account and billing management, beta invite systems, and plugin-adjacent design workflows such as the current Figma and Sketch integrations.

Some features are experimental, invite-only, or labelled as beta. Beta features may be incomplete, may change faster than general-release features, and may be modified, suspended, or removed without prior notice.

Subscriptions And Billing

Some product capabilities are gated by paid plans or seat-based team subscriptions. Payments for paid plans are currently processed by Stripe, and subscription state is used to determine access to paid capabilities such as publishing, custom slugs, exports, private publishing controls, and team billing features.

By starting a paid subscription, you authorize the applicable recurring billing flow for the selected plan interval and seat quantity. You are responsible for keeping your billing details current and for managing cancellation or plan changes through the billing surfaces we make available.

If payment fails, a subscription lapses, or billing access is revoked, paid features may be limited, suspended, or removed in line with the current entitlement and webhook logic used by the service.

Except where required by law, including under the Australian Consumer Law, or where we expressly state otherwise at checkout or in a written plan offer, subscription fees are generally non-refundable for the current billing period and cancellations operate prospectively from the next renewal point or the end of the already-paid term.

You are responsible for any taxes, duties, bank fees, or similar charges associated with your subscription unless the law requires us to collect and remit them differently or unless we expressly state otherwise in the checkout flow.

Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, non-excludable warranty, or other right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

Where a law implies a guarantee, condition, or warranty into these Terms and permits liability to be limited, our liability for breach of that non-excludable guarantee, condition, or warranty will be limited to the minimum extent permitted by law.

Your Content And Sharing Choices

You are responsible for the palettes, names, descriptions, tags, exports, and other content you create, upload, publish, or share through Colour Curver. You must have the rights needed to use and share that content.

You retain responsibility for your content, but you give us the permission needed to host, store, copy, transform, transmit, and display it as required to operate the service features you choose to use, including editing, collaboration, export, private sharing, public publishing, moderation, backup, and recovery flows.

Public palettes can be discovered by other users and may show metadata such as title, slug, colours, description, tags, author or team identity, and interaction counts. Private sharing and password protection reduce visibility but do not eliminate the risk that recipients may copy, forward, or redistribute content you share.

Colour Curver Intellectual Property And Feedback

Except for your content and any third-party material that belongs to its respective owner, Colour Curver, its product design, branding, site content, software, documentation, and related materials remain the property of the operator or relevant licensors and are protected by applicable intellectual property laws.

If you send feedback, suggestions, ideas, bug reports, or product requests to us, you agree that we may use, adapt, and build on that feedback without restriction or payment, provided that this does not change your ownership of your separate user content.

Teams, Workspaces, And Collaboration

If you use team or workspace features, your access is controlled by roles, permissions, and invitation state managed through the current collaboration system. Owners, admins, and other authorised members may be able to view membership, invites, workspace access, palette metadata, and activity relevant to those collaboration surfaces.

If you invite others, you are responsible for choosing the correct roles and access targets. If you accept an invite, your access can later be changed, narrowed, suspended, or revoked by authorised administrators or by platform policy.

Acceptable Use

You must use Colour Curver lawfully and responsibly. You must not attempt to bypass access controls, scrape or abuse private routes, interfere with the service, defeat rate limits, send spam or abusive invites, upload malicious material, infringe the rights of others, or use the product to distribute content you do not have permission to share.

You must not use automated or manual methods to disrupt the product, overload infrastructure, probe for vulnerabilities without authorisation, or misuse collaboration, beta access, feedback, publishing, or plugin flows in a way that harms users, providers, or the service.

Availability, Changes, And Suspension

We may change, pause, or discontinue features, limits, integrations, plan entitlements, export options, and collaboration tools at any time, especially during active development and beta rollout.

We may suspend or terminate access, remove content, revoke invites, cancel private links, or close accounts when reasonably necessary to protect the service, comply with legal obligations, address security or billing issues, investigate abuse, or enforce these Terms.

Termination And Survival

You may stop using the service at any time. We may suspend or terminate all or part of your access under the circumstances described in these Terms or where continued access would create legal, security, billing, or operational risk.

Any provisions that by their nature should survive termination will survive, including provisions dealing with payment obligations already incurred, intellectual property, user-content permissions already granted for operational copies and backups, disclaimers, liability limits, dispute handling, and general legal interpretation.

Disclaimers

To the maximum extent permitted by law, Colour Curver is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, permanent support for every integration, or that every exported, shared, or published asset will always remain available in the same format.

Accessibility checks, publishing flows, billing logic, collaboration tools, and beta features are provided to support your workflow, but you remain responsible for reviewing your own output, rights, and compliance obligations before using it in production or sharing it with others.

Limitation Of Liability

To the maximum extent permitted by law, Colour Curver and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to your use of the service.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability that cannot be excluded under the Australian Consumer Law, but you agree that your use of the service is at your own risk and that any recovery will be limited to the remedies available under applicable law.

Governing Law And Disputes

These Terms are governed by the laws applicable in the State or Territory in Australia where the operator of Colour Curver ordinarily resides, together with the laws of Australia applicable there, unless a non-excludable law requires otherwise.

If you are an Australian consumer, you may have rights to bring a claim in a court or tribunal that has jurisdiction where you live or where the operator is based. Otherwise, you and we submit to the non-exclusive jurisdiction of the courts of the relevant Australian State or Territory and any courts hearing appeals from them.

General Terms

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

We may assign, novate, or transfer these Terms and the operation of the service to a future Australian company, purchaser, or successor as part of a restructure, sale, or company formation. You may not assign your rights or obligations under these Terms without our prior written consent, except where the law prohibits that restriction.

These Terms, together with any plan-specific pricing, checkout terms, product notices, and policies expressly incorporated into them, form the entire agreement between you and us regarding your use of Colour Curver.

Changes To These Terms

We may update these Terms as the product, pricing, provider stack, plugin support, publishing model, or legal requirements change. Your continued use of Colour Curver after updated Terms take effect means you accept the revised Terms.
